Terms of Services and Privacy Policy
Entire Agreement This agreement contains the entire understanding between Ira Rozen Photography, hereinafter referred to as The Photographer and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing and agreed to by all parties involved.
Payment & Prices All Package costs are as stated at the time of booking & will remain once booking is confirmed. Upon your purchase, The Photographer will reserve the time, date and necessary equipment to facilitate the shoot. For this reason, the payment is non-refundable unless arrangements have been made in writing prior to the shoot commencing.
All credit card transactions carried out in connection with purchases from this website are transacted via third parties using secure servers. No financial details are retained on our server and the third parties only confirm to us that payment has been received and the name, email address and shipping address of the purchaser. The third parties do not communicate credit card or any other details to us and have their own, strict, privacy policies in place
Refund Policy Due to the nature of our photography services and our delivery system, we are unable to provide refunds on the photography services. Once galleries have been delivered to the Client via either SMS (text message) or Email, Client has the freedom and ability to download and share the images at will. The photographer assumes and expects that the Client will download all images once the gallery is received and as such, it is deemed to be completed and accepted work. We are not able to provide a refund on the photography services ordered and paid for by the Client and delivered by the Photographer. Exceptions will be made on a case by case scenario.
Reschedule Client may reschedule with the Photographer by providing notice at least 48 hours prior to the photo shoot. The photographer will confirm if the requested new time is available and confirm with the Client. If the new requested time is not available, then the Photographer will propose a new time and confirm with the Client.
Torrential Weather If the weather is torrential and Photographer determines shoot is not possible, the session will be rescheduled for another day.
Use of Personal Camera Client may not bring own camera or recording equipment to the session. If a camera is present, Photographer will have to request that it be put away.
Requested Coverage The Photographer will attempt to honor requested photographs but does not guarantee any specific photographs. Due to the fast paced nature of sports/action photography, we cannot guarantee specific poses, shots, jumps, leaps or any specific shots as related to a specific sport.
Cooperation & Physical Liability All parties agree to cheerful and provide the best cooperation and communication for the best possible result. Photographer is not responsible for missed images due to any individual’s failure to appear or cooperate during the Assignment. If there is any threat to the Photographer or their equipment by any subject, Photographer reserves the right to end coverage immediately with no further liability to finish the Assignment, with no refunds given. Additionally, Client is responsible for their own conduct and the conduct of all participants in the Session. Any damage to equipment or studio components caused by the Client are the sole financial responsibility of the Client. Client agrees to hold Photographer harmless for any injuries or damages sustained preceding, during, and immediately following the Assignment.
Copyright & Reproductions The Photographer owns the copyright to all images created during the Session and shall have the exclusive right to make reproductions. The Photographer, at its sole discretion, may transfer the rights of the images to the Client. The Photographer maintains the right to make reproductions for the Client or for the Photographer’s portfolio, self-promotions, entry in photographic contests or art exhibitions, editorial use, or for display within or on the outside of the Photographer’s studio.
Confidentiality and Privacy The Photographer and it's photographers take great pride in maintaining the highest level of confidentiality. Photographs from the session are stored in a secured location not accessible to the public. Any galleries posted online for the Client to review will be password protected and not available for public viewing.
Our website automatically receives and records information on our server logs from your browser, including your IP address, type of browser used, and the page you requested. The information from the server logs is used for general website administration and optimization and is NOT matched or otherwise correlated to individual users.
When you purchase products or services, we collect additional information needed to complete the transaction such as your shipping address, telephone number, and other billing information.
The Photographer does not rent, sell or share personal information.
The information that we receive or collect from you is used for the following general purposes: to provide updates to you regarding our products and services, to fulfill your requests for products and services, improve our products and services, contact you, conduct research, and to optimize and improve our website.
The Photographer will not knowingly contact children under the age of 13 without a parent’s permission.
Every client has the right to access data, request changes, deletion, and corrections.
Social Media and Promotion The Photographer encourages sharing of the final product via social media outlets. Certain events are designed for The Client to post images to social media platforms and are encouraged to do so. Photographs shared on Facebook, Twitter, Instagram, Snapchat or any other social media platform should retain the watermark and metadata from The Photographer and/or include tags to The Photographers website or social media profiles. The Photographer may use select edited photographs in the promotion of its website, social media or other marketing platforms. The Client may request in writing that none of their images be used by The Photographer for marketing and social media promotion.
Photographer The Photographer may substitute another photographer to take the photographs in the event of Photographer’s illness or personal crisis. In the event of such substitution, Photographer warrants that the photographer taking the photographs shall be a competent professional.
LIMIT OF LIABILITY In the unlikely event that the Photographer cannot perform this Agreement due to a medical or natural emergency, or other cause beyond the control of the Photographer, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
Inherent Qualities Client is aware that color dyes in photographs and photography products may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.
